These Terms of Use (“Terms”) govern your access to and use of xcevia.com (the “Site”), which is owned and operated by Xcevia Ltd. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About us

Xcevia Ltd is a private limited company registered in England and Wales (company number 16737253). We are referred to in these Terms as “Xcevia”, “we”, “our”, or “us”. We can be contacted at info@xcevia.com.

2. Use of the Site

The Site is provided for general information about Xcevia, our services, and our products. You may access and browse the Site for lawful purposes, provided you do not:

  • Use the Site in any way that breaches applicable laws or regulations of the United Kingdom, the European Union, or any other jurisdiction from which you access the Site.
  • Use the Site to transmit unsolicited communications, malicious code, or anything that interferes with the operation of the Site or any connected systems.

3. No client relationship by use of the Site

The content of the Site is provided for general information only. It is not intended to amount to advice on which you should rely. We make no representations, warranties, or guarantees, whether express or implied, that the content of the Site is accurate, complete, or up to date.

Browsing the Site, submitting a contact form, or otherwise corresponding with us does not, by itself, create a consulting, advisory, or service relationship between you and Xcevia. Any engagement will be governed by a separate written agreement signed by both parties.

4. Services and products

Xcevia's services are provided by Xcevia Ltd as the contracting entity. Specific service descriptions, deliverables, fees, and terms will be set out in an order form, statement of work, or product subscription agreement entered into between you and Xcevia Ltd.

Where you are evaluating early-access or design-partner versions of our products, those products are provided on an “as is” basis. Features, pricing, and availability may change as the products evolve.

5. International users

The Site is operated from the United Kingdom. We make our services available to clients in the UK, the European Economic Area, and other countries. If you access the Site from outside the United Kingdom, you do so at your own initiative and are responsible for compliance with any applicable local laws.

6. Intellectual property

All trademarks, logos, content, designs, code, and other materials on the Site are owned by or licensed to Xcevia Ltd and are protected by copyright, trademark, and other intellectual property laws.

You may view, download, and print extracts of the Site for your personal, internal, non-commercial reference only. You may not otherwise reproduce, modify, distribute, or publicly display any part of the Site without our prior written consent.

7. Third-party links

The Site may contain links to third-party websites, including content hosted on platforms such as LinkedIn and external blog services. We do not control those websites and are not responsible for their content, availability, or privacy practices. The inclusion of any link does not imply endorsement.

8. Disclaimers

To the maximum extent permitted by law, the Site is provided on an “as is” and “as available” basis, without any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the laws of England and Wales, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

9. Limitation of liability

Subject to the previous section, Xcevia's total aggregate liability arising out of or in connection with your use of the Site, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed one hundred pounds sterling (£100).

We will not be liable for any loss of profits, loss of business, loss of revenue, loss of anticipated savings, loss of goodwill, loss or corruption of data, or any indirect or consequential loss, however arising.

Liability arising from a signed engagement, product subscription, or service contract is governed by that separate agreement and not by these Terms.

10. Indemnity

You agree to indemnify Xcevia against all claims, losses, damages, costs, and expenses (including reasonable legal fees) suffered or incurred by us arising out of your breach of these Terms or your misuse of the Site.

11. Changes to these Terms

We may update these Terms from time to time by posting a revised version on this page. The “Last updated” date at the top of these Terms indicates when the latest changes were made. Your continued use of the Site after a change indicates your acceptance of the revised Terms.

12. Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims), are governed by and construed in accordance with the laws of England and Wales.

You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim, except that consumers resident in another part of the UK or in the EEA may bring proceedings in the courts of their place of residence as required by applicable law.
